Scope of This Policy

This Privacy Policy applies to the information we collect from or about individuals through the publicly available portions of this Site. It does not apply to information we collect through other channels, such as over the phone or in-person. It also does not apply to information we collect from or about students through our platform licensed by our customers, which is accessible only with a login and password. Your Choices

Cookie Preferences. You can manage your cookie preferences at any time by clicking the “Cookie Preferences” link in the footer of any page on this Site. This opens a preference panel where you can control which categories of non-essential cookies are active.

Global Privacy Control (GPC). We honor Global Privacy Control signals. If your browser sends a GPC signal, we treat it as a valid request to opt out of the sale or sharing of your personal information, as required by the CCPA and other applicable state privacy laws. Information You Provide to Us

We collect information you provide directly when you use this Site. Our forms on this Site are intended for use by K-12 educators, school administrators, and district decision-makers. Information collected may include your name, email address, phone number, school or district name, job title, state, and any other information you choose to provide when you complete any kind of contact form, like requesting a quote, subscribing to our newsletter, registering for a webinar, downloading marketing content, or participating in our referral program.

Information Collected Automatically

When you visit this Site, we use cookies and similar technologies to collect certain information from your browser or device, but only after you have provided consent through our cookie banner. This anonymized information may include your browser type and version, operating system, referring URL, pages visited, date and time of your visit, and general geographic region. We use this information to analyze website traffic, improve our Site, and measure the effectiveness of our marketing. If you do not consent to non-essential cookies, we collect only limited, anonymized data that also cannot be used to identify you. Google Analytics 4 (GA4). We use Google Analytics 4, a web analytics service provided by Google LLC, to analyze website traffic and usage patterns in aggregate. GA4 uses first-party cookies (such as _ga and _ga_*) to distinguish unique visitors and track session information. The data collected includes pages visited, time spent on pages, traffic sources, general geographic region, and device/browser type. We use this information solely to understand how visitors use our Site and to improve its content and functionality.

GA4 does not collect your name, email address, or other directly identifying personal information. We have disabled ads personalization in GA4 for visitors from states with comprehensive privacy laws, and Google Signals is turned off. We have executed Google’s Data Processing Amendment, which establishes Google as a data processor acting on our behalf for analytics data. HubSpot. We use HubSpot’s tracking code and marketing tools on this Site. HubSpot sets first-party cookies (such as __hssc, __hssrc, __hstc, and hubspotutk) to recognize returning visitors, support our contact forms, and enable our email communications. When you submit a form on this Site, HubSpot associates your browsing activity with the contact information you provide. HubSpot processes this data under a data processing agreement with Progress Learning. We do not use HubSpot’s Intent data sharing or Breeze Intelligence features, which means HubSpot does not use your data for its own advertising or profiling purposes. Google Display Advertising. We run display advertising campaigns through Google Ads, including remarketing campaigns that may show Progress Learning ads to users who have previously visited this Site. Google uses cookies (such as _gcl_au) to support conversion tracking and to serve relevant ads to past visitors across its advertising network. We may use this information for inclusion or exclusion purposes or to create lookalike audiences. These cookies are set only after you provide consent through our cookie banner. If you do not consent, no advertising cookies are placed and no data is shared with Google for ad targeting purposes.

We do not currently use audience tools within Google Ads, such as Customer Match, to reach users who have previously provided their contact information to us directly (for example, through a form submission or business inquiry). In such cases, that information is uploaded to Google in hashed form for the sole purpose of ad targeting and is handled under Google’s data processing terms.

We may import anonymized GA4 analytics audiences or segments into Google Ads for targeting purposes. This GA4 data is only collected after consent is given via the cookie banner and does not contain personal information.

You can opt out of Google’s use of cookies for advertising by visiting Google’s Ads Settings at adssettings.google.com or by visiting the Network Advertising Initiative’s opt-out page at optout.networkadvertising.org.

Essential Cookies. Some cookies are strictly necessary for the operation of this Site, such as cookies that maintain your session, remember your cookie preferences, or support security features (e.g., Cloudflare bot protection). These cookies do not collect personal information for marketing purposes and cannot be disabled.

In Aggregate or De-Identified Form. We may share aggregated or de-identified information that cannot reasonably be used to identify any individual. This information may be used for analytics, research, industry benchmarking, or reporting on general usage trends.

As Part of a Business Transfer. Your information may be transferred to a successor organization if, for example, we transfer the ownership or operation of this Site to another organization or if we merge with or are acquired by another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Privacy Policy and the privacy preferences you have expressed to us.

Sources of Personal Information. We collect personal information from the following sources only when it is voluntarily provided by users: directly from you when you submit forms or contact us; from your browser or device when you consent to data collection via our Cookiebot banner; and from our service providers (such as aggregate analytics data from Google and contact activity data from HubSpot).

Business or Commercial Purposes for Collection. We collect personal information for the purposes described in the “How We Use Your Information” section above: providing requested services, communicating with you, improving our Site, measuring advertising effectiveness, ensuring security, and complying with legal obligations.

Categories of Third Parties to Whom PI Is Disclosed. We disclose personal information to our service providers (Hubspot, only when the user discloses their information through a form) for the business purposes described in this Privacy Policy. We may also disclose information to law enforcement or other parties when required by law.

Sale and Sharing of Personal Information. We do not sell personal information as defined by the CCPA. We do not share personal information for cross-context behavioral advertising as defined by the CPRA. Our analytics and advertising service providers process data on our behalf under data processing agreements and are contractually restricted from using it for their own purposes.

We will verify your identity before processing your request by matching the information you provide in your request with information we have on file. If we cannot verify your identity, we may ask for additional information or deny the request. You may also designate an authorized agent to make a request on your behalf.

Retention Periods. We retain personal information for as long as necessary to fulfill the purposes for which it was collected, as described below:

Children’s Privacy

This Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 through this Site. Our forms are designed for and intended to be used exclusively by K-12 educators, school administrators, and district decision-makers. We do not solicit, request, or desire personal information from parents, guardians, or students through this Site.

In the event that a parent, guardian, or student submits information through a form on this Site, we treat that submission as outside our intended audience. Such submissions are not used for marketing purposes, are not added to marketing contact lists, and are flagged for removal from our systems. We make reasonable efforts to identify and filter out form submissions that do not originate from K-12 education professionals.

If you are a parent or guardian and believe your child has provided personal information to us through this Site, please contact us at [email protected] so we can take appropriate action to delete that information.

Our student-facing platform, accessible only via login credentials provided by a school or district, is governed by a separate Product Privacy Policy and applicable student data privacy agreements with our school and district customers. The marketing website (this Site) and the student platform are separate systems with separate data practices.

Data Security

We maintain reasonable administrative, physical, and technological measures to protect the confidentiality and security of your personal information. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

Accessing, Updating, or Correcting Your Information

You may request access to, correction of, or deletion of your personal information by contacting us at [email protected] or by calling 877-377-9537. We will respond to verifiable requests within the time limits required by applicable law (45 days under the CCPA, with a possible 45-day extension if reasonably necessary). We may ask you for additional information to verify your identity before processing your request. If we deny your request in whole or in part, we will explain the reason and inform you of your right to appeal.

Referral Program

We offer a referral program that rewards participants for referring new customers to Progress Learning. Participation is voluntary. To participate, you must introduce a referral to Progress Learning via email. This introduction would provide the referral’s email address and name by way of email. This data is not collected on the website. The value of any referral reward is based on the estimated business value of a successful customer acquisition and is not calculated based on the value of the personal information you provide.

You may opt into the referral program at progresslearning.com/referral-program/. You may withdraw from the referral program at any time by contacting us at [email protected], and we will cease using your information for referral program purposes within a reasonable timeframe. Business Contact Information

The personal information we collect through this Site primarily consists of professional contact information provided by educators, administrators, and district decision-makers in their professional capacity. This information is collected and used solely for business-to-business purposes: responding to inquiries, providing requested services, and communicating about our products. We do not use professional contact information collected through this Site for consumer marketing unrelated to our educational products and services.

International Visitors

This Site is intended for use by visitors located in the United States. Our services are designed for U.S.-based K-12 schools and districts, and our content, forms, and marketing are directed exclusively at the U.S. education market. We do not target, solicit, or knowingly collect personal information from individuals outside the United States.

If you access this Site from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where our servers and service providers are located. By using this Site from outside the United States, you acknowledge that your information may be subject to U.S. laws, which may differ from the laws of your country.

Form submissions and data received from individuals outside the United States are treated as outside our intended audience and are not used for marketing purposes. We make reasonable efforts to identify and exclude non-U.S. data from our active marketing systems.
